New Mexico Interlock Program Guide

Everything you need to protect your license, stay compliant, and successfully complete your ignition interlock program in New Mexico.

Understanding DWI's in New Mexico

In New Mexico, if you are convicted of DWI, the only legal way to drive during revocation is with an Ignition Interlock License and a properly installed interlock device.

Civil Side (MVD)

Administrative license revocation handled by MVD.

Criminal Side (Court)

Court penalties may include fines, probation, and mandatory interlock period.

How to Obtain a New Mexico Interlock License

  • ✓ Proof of Identification
  • ✓ Two Proof of NM Residency
  • ✓ Current Interlock Contract (VIN + provider signature)
  • ✓ Current Insurance listing you as covered driver
  • ✓ Notarized Affidavit (MVD-10456) - We provide this at installation.
  • ✓ Applicable MVD fees + contractor fees if you visit a non-state field office.
Important:

Your contract must be current on the day you visit MVD. A receipt alone is not sufficient.

How the Interlock Device Works

In New Mexico, your interlock prevents the vehicle from starting until you provide an acceptable sample (below .025%), and it will also require random “rolling retests” while you drive.

Step-by-step: How to blow (Blow → Inhale) +

Goal: A steady and consistent exhale (blow).

  1. Take a normal breath (don’t hyperventilate).
  2. Blow steadily into the mouthpiece.
  3. Without removing your mouth, inhale through the mouthpiece.
  4. The device analyzes the sample and allows the vehicle to start.

Tip: You'll get to try the device first - the Draeger XT is incredibly easy to use.

Rolling retests (what they are + how to handle them) +

New Mexico devices require “random rolling retests” at intervals while you drive. The retest is designed to confirm the driver remains alcohol-free.

  • You can safely continue driving during the countdown OR pull over to complete a retest.
  • Find a steady speed/position and do the same blow → inhale pattern.
  • Do not ignore prompts; the goal is to provide every test the device requests.
What counts as non-compliance (and what to do if it happens) +

Your device detects and records non-compliance, circumvention, and tampering.

  • If you fail a test: you will have the opportunity to retry within 5 minutes. If a fail happens during a Rolling Retest pull over somewhere safe and out of traffic before turning the vehicle off.
  • If you used mouthwash / hand sanitizer / cologne: wait, rinse with water, and retest. Avoid alcohol-based products before driving.
  • Never unplug, bypass, or attempt “workarounds.” If you are going to work on your vehicle or replace/disconnect your battery call us first.
Cleaning & Care +

The device is very low maintenance:

  • Keep mouthpieces clean, dry and replace as needed.
  • Don’t leave the handset where it can bake in direct sun or freeze overnight if avoidable.
  • Don’t spray cleaners into the handset (cover with bag during interior car cleanings or disconnect while engine is off.
Vehicle repairs, battery issues, and mechanic visits +

If

  • If your vehicle is going to a shop, have the mechanic call us before they start work.
  • Battery issues can impact interlock behavior. If the battery dies, call us before attempting repeated starts.
  • Do not allow anyone to remove dash panels or device wiring without authorization.
Service visits, calibration, and why appointments matter +

NM servicing rules commonly require a service visit within 30 days after install and up to every 60 days thereafter, and calibration at least every 60 days.

  • Missing a service appointment can lead to a lockout or compliance issues.
  • If you can’t make it, please contact our office asap.

Indigent Fund Assistance

If approved through the New Mexico Traffic Safety Division, assistance may cover:

  • ✓ Up to $50 installation
  • ✓ $30 per month
  • ✓ Up to $50 removal
